The February 16, 1991, when Cheryl Summerville was called to the manager's office, had heard that the restaurant, Cracker Barrel, had formalized a policy of dismissing lesbian, gay men, and that all employees would be questioned regarding their sexual orientation. She worked and lived in a small town in Georgia, so his departure was even more devastating to her than could have been less isolated in other large cities. The reason for the defeat after defeat, even amid much more support to these basic rights is the power of capital. They do not want their hands tied intrometidas regulations, especially the legal rights that are enforceable in court. Some companies have come under pressure and have established policies in their companies that are not as legally binding.
But others such as Exxon and military contractor KBR (the largest non-union construction company in the U.S.) even refuse to issue even a policy against discrimination based on sexual orientation. These companies join many others from Berkshire Hathaway to Philip Morris, JM Smucker, Publix Supermarket, Sysco Corp, Dish Network and Advance Auto Parts, among others that are part of the latest report of the Fund Human Rights Campaign released this year.
So Who you gonna call when there is no law? The only entity that can establish rights that management must respect even when no law is a union.
When so few workers have unions, especially the office, food service, personal care, department stores, etc., it may be hard to imagine what that means and why LGBT activists worry about unions or why unions care for LGBT people.
Many people connect unions only paychecks in the manufacturing sector, mostly with white men and therefore is a part irrelevant to their lives. For decades, this was a tragic reality while union leaders saw their responsibility more closely in relation to wages, hours, benefits and seniority, and nothing more. Of course it was never easy. Each issue contained a question - is this a right for all, a right for workers of color and white women and LGBT workers and workers. Who forced these questions are asked? How unions became vehicles today that are or can be pro LGBT rights at work?
We are everywhere and we have always been part of the struggle for justice in the workplace.
